The short version: We run a map and a payment system that connects people who need beach parking ("Parkers") with people who have driveways ("Owners"). Every booking is a deal between the Parker and the Owner β not with us. Everyone uses this service at their own risk.
1. Who we are
These terms are between you and ParkTheBeach, operated by Glover Road, LLC, a North Carolina limited liability company ("we," "us," "the Service"). By using the Service β browsing, booking, or listing β you agree to these terms. If you don't agree, don't use the Service. You must be at least 18 years old and able to enter into a binding contract to use the Service.
2. We are a marketplace, not a party to the parking
We provide the map, the listings, the booking system, and payment processing (through Stripe). We do not own, control, inspect, or manage any parking spot. The parking arrangement is solely between the Parker and the Owner. We are not a real estate broker, an agent for either party, an insurer, or a bailee of any vehicle. ParkTheBeach is a venue platform and never takes custody, care, or control of any vehicle: a booking is a revocable license to park only β not a bailment β and the Parker keeps full responsibility for their vehicle and its contents at all times.
3. What a booking is
A booking is a revocable license for one vehicle to occupy the Owner's designated spot during the booked time window. It is not a lease, does not convey any interest in real property, and grants no rights beyond parking one vehicle in the marked spot.
4. Parker rules
- Park only in the spot shown in the listing photo and description. One vehicle per booking.
- Provide an accurate license plate and phone number. Bookings with false information may be canceled without refund.
- Leave by your end time. A vehicle left past the booked window is unauthorized. You agree it then becomes subject to towing or booting at your sole expense (actual towing and storage costs), that the Owner may authorize its removal under applicable North Carolina law, and that we may bill you a reasonable overstay fee for the extra time. The end time is what protects the Owner's own use of their driveway β treat it as firm.
- No blocking sidewalks, other vehicles, or neighboring property. No trailers, campers, or overnight stays unless the listing says otherwise.
- The address you receive is private. Don't share it or return without a new booking.
5. Owner rules
- You must have the legal right to offer the spot (owner, or a tenant with landlord permission; compliant with any HOA or lease restrictions). Listing confirms you have that right.
- Your listing β address, photo, description, hours β must be accurate.
- Keep the spot available for the times you list it, or cancel promptly (the Parker is refunded in full automatically).
- You are responsible for the condition of your property. You warrant that your parking area is free of known hidden hazards (for example exposed rebar, an unmarked drop-off, or an aggressive unrestrained animal) and that you will warn Parkers of any danger that isn't obvious.
- Local rules are on you. You are solely responsible for confirming that listing your driveway complies with all applicable municipal codes, zoning and signage rules, HOA covenants, and lease terms. ParkTheBeach disclaims all liability for any municipal fine, code citation, or HOA penalty levied against you for listing.
6. Money
- Owners set their own prices. Parkers pay the listed price plus a card processing fee (2.9% + $0.30) at checkout.
- Our platform fee is 20% of the listed price, deducted from the Owner's payout. Founding Owners (the first 50 to complete a booking) pay a 0% platform fee through December 31, 2027.
- Payouts are made to Owners through Stripe Connect. We never hold Owner funds outside of Stripe's payment flow.
- Cancellations: Nothing is charged for roughly the first hour after a booking β the card is only authorized (held). A Parker may cancel free within 20 minutes of booking a same-day spot, or, for a spot reserved for a future day, any time before midnight Eastern the night before that day; the hold is released and no charge is made. After that window a booking is final. An Owner may cancel within 5 minutes of a booking on their own; after that, an Owner who cannot honor a booking must contact us at support@parkthebeach.com and we will cancel it for them. Whenever a booking is canceled by the Owner or by us, the Parker is made whole in full β refunded if already charged, or the hold released if not. No refunds for weather.
7. Assumption of risk β read this
Everyone uses the Service at their own risk. Parkers park at their own risk: we and the Owner are not responsible for damage to or theft of your vehicle or its contents, except to the extent caused by the Owner's own conduct and provable at law. Owners list at their own risk: we are not responsible for damage to your property, and we do not provide any insurance to anyone. You are responsible for your own insurance decisions.
8. Release and indemnity
To the fullest extent permitted by law, you release us (and our owners, employees, and agents) from any claim arising out of a parking arrangement between a Parker and an Owner β including property damage, personal injury, towing, or disputes about the spot. You agree to indemnify us against third-party claims arising from your use of the Service or your violation of these terms. As a Parker, you enter and use the Owner's property at your own risk, and to the fullest extent permitted by law you release and will indemnify the Owner (as well as us) for personal injury you suffer on the property that is not caused by the Owner's gross negligence or willful misconduct.
9. Limitation of liability
To the fullest extent permitted by law, our total liability to you for any claim arising out of the Service is limited to the amounts you paid to us in platform fees in the 12 months before the claim (for Parkers, the amount of the booking at issue). We are not liable for indirect, incidental, consequential, or punitive damages. The Service is provided "as is" without warranties of any kind.
10. Records and data retention
For each booking we retain the parker's license plate and state, vehicle make and model, phone number, a photo of the vehicle in the spot, and booking times for 12 months, after which these records are deleted. This information is collected and used solely for booking verification, security, and resolving disputes. Owners can view it for their own spots to identify the booked vehicle and coordinate that booking β an Owner may not use a Parker's license plate, phone number, or photo to contact the Parker off-platform, for marketing, or for any purpose unrelated to the booking, and doing so can result in removal from the Service. In the event of an incident, we will provide the records on file to the affected party and cooperate with law enforcement. We are the record-keeper, not a party to any dispute between an owner and a parker.
11. Enforcement, suspension, and disputes between users
Anyone can report a listing to support@parkthebeach.com. We may remove listings, cancel bookings (with refund to the Parker), or suspend any account at our discretion to keep the Service safe and honest β and we typically pause a reported listing while we review it. Disputes between a Parker and an Owner (damage claims, towing, etc.) are between those parties; we will provide relevant booking records to either party on request.
12. Governing law and disputes with us
These terms are governed by the laws of North Carolina, without regard to its conflict-of-laws rules.
Binding arbitration. Except for the two exceptions below, you and we agree that any dispute arising out of or relating to these terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in New Hanover County, North Carolina, or by phone or video, or anywhere else we both agree. The arbitrator's award may be entered as a judgment in any court with jurisdiction. You and we are each giving up the right to a trial before a judge or jury.
No class actions. You and we may each bring claims only on an individual basis β not as a plaintiff or class member in any class, collective, consolidated, or representative action. The arbitrator may not combine more than one person's claims or preside over any form of class proceeding. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and heard in court; the rest of this section still applies.
Two exceptions. (1) Either of us may bring a qualifying individual claim in small-claims court in New Hanover County, North Carolina. (2) Either of us may ask a court for an injunction to stop infringement or misuse of intellectual property β for example our brand, our software, or our data.
You can opt out within 30 days. This arbitration section is not take-it-or-leave-it. To reject it, email support@parkthebeach.com with the subject βArbitration opt-outβ and your name plus the email or phone on your account, within 30 days of first accepting these terms. Opting out costs you nothing and changes nothing else β your account is unaffected and the rest of these terms still apply.
If arbitration doesn't apply. If you opt out, or a dispute falls outside this section, that dispute will be brought only in the state or federal courts located in New Hanover County, North Carolina, and you consent to personal jurisdiction and venue there.
13. Changes
We may update these terms. The version date below applies to bookings made after that date; each booking records the terms version in effect when it was made. Continued use after changes means you accept them.

Privacy Policy & SMS
We collect the phone numbers, vehicle details, and booking information you provide in order to operate the parking marketplace β connecting parkers with owners, delivering addresses, sending booking notifications, and processing payments. We do not sell your personal information.
SMS consent: When you provide your mobile number, you consent to receive transactional and account-related text messages from ParkTheBeach (booking confirmations, spot addresses, owner alerts, and occasional reminders to owners). Message and data rates may apply, and message frequency varies. You can opt out at any time by replying STOP, or reply HELP for assistance. Opting out of texts may limit core functionality (for example, receiving your parking address). Mobile information is never shared with third parties or affiliates for marketing purposes; it is used only to deliver the ParkTheBeach service.
